Domain escrow service conditions
The NICIT escrow service is the safe method for buyers and sellers in order to avoid incurring risks in domain conveyance. After successfully placement of orders through the NICIT escrow fund transfer, domain conveyance is supervised by the NICIT escrow team. The buyer transfers the escrow amount (purchase price) for the domain, either including or in addition to the NICIT fees, depending on whether the buyer or the seller bears the costs for the escrow order, to the escrow account provided by NICIT. Upon receipt of the escrow amount, as well as the NICIT escrow fees, the seller receives a message confirming that the amount of money has been received correctly and that he can approve the domain conveyance to the buyer. The domain's conveyance is performed by the buyer and seller independently, in collaboration with their domain providers. NICIT is available for consultation by E-mail. In most cases domain conveyance is so simple that even an inexpert person can perform the transaction. As the domain providers are always ready to offer their support, using an additional direct service by NICIT is not necessary and can lead to higher costs for all parties.

Information about the domain conveyance process: The seller and the buyer communicate via e-mail. 1. The seller notifies the domain provider that another provider will submit for the buyer a so-called KK-request (Konnektivitäts-Koordination, the German version of the CTSR -- Changing the Sponsoring Registrar -- for .de domains) for the conveyance of the domain. It has also proved helpful to notify the domain provider in advance of the buyer's full address and of the new provider. 2. Approximately one day later, the buyer submits a request for a domain with his provider, and as the domain has already been registered, this request is called a KK-request (CTSR or change of provider). A KK-request can generally be placed online or sent as an email with no specific form to the Customer Support Center. The seller must generally send his provider the following fax: "Notice of cancellation and change of provider" or "Notice of cancellation and change of holder". The provider can accept the notice of cancellation only if the KK-request from the buyer has arrived - otherwise the domain will remain registered in the seller's name as the current holder. There are variations from provider to provider. This is the procedure for a .de domain. With other extensions, such as .com, .net, .info, another blockade (lock) must usually be released either in the customer menu or in the customer support center, and in addition to this an authentication code has to be sent to the buyer, who needs it in order to be able to register the domain in his/her name - for this there is often no longer a written form available. There are various conveyance possibilities, and they can all easily be accomplished with our assistance and the support of the provider.

The buyer and the seller have to undertake in cooperation all additional actions that are necessary for the conveyance of the domain to the buyer.

Once the providers have conveyed the domain to the buyer, the provider shall change the domain holder entry for the benefit of the buyer. If the NICIT escrow team can establish the correct domain ownership of the buyer, NICIT will transfer the escrow amount, after having deducted the NICIT escrow fees, into the seller's bank account.

Refusal of escrow orders by NICIT and restrictions - If a domain transfer, contrary to expectations, is not performed, or if it is accompanied by significant difficulties, NICIT may decide to refuse the order retroactively, and in consultation with the parties, pay back the escrow amount for the benefit of the buyer.

NICIT reserves its principal right to refuse an escrow order after it has been received and checked. In addition, the escrow service is offered primarily to customers from Germany. Parties from EU-countries and the USA are also generally accepted, but NICIT reserves its right, and this applies to other countries as well, to examine such orders for a longer period of time to be able to decide whether to accept such orders or not. An order may be considered accepted if NICIT does not send a refusal email to the party concerned within 5 days upon receipt of the order. However, NICIT reserves the right to refuse an order retroactively.

The service is primarily intended for domains with TLDs .de,.com,.eu,.net,.org,.info,.biz,.at,.ch For all other TLDs, NICIT reserves the right not to accept an order. Orders with TLDs where ownership data are unavailable to NICIT for (public) examination cannot become a constituent part of a NICIT escrow order.

The escrow conveyance is performed only for domain names, and for no other goods or values.
Domain packages
If a total domain package is sold and needs to be conveyed, NICIT charges for the first domain a conveyance fee of 2% for the total value of the domain conveyed, but at least 35,00? and at most 1,750.00?. The precondition for this offer for domain packages is that the purchase price for the whole domain package is paid into NICIT's escrow account as a single payment and that NICIT must make only one out payment, i.e. there are no partial payments and the out payment is made only when all domain names are successfully conveyed to the buyer.
Means of communication and documents
The correspondence between NICIT, the buyer, and the seller generally takes place by E-mail. If the dealings involve higher amounts (NICIT decides at its own discretion what is considered a higher amount), NICIT can request written confirmation of orders and delivery of the written purchase and sales agreement upon which the parties agreed.
Bank charges
Under no circumstances will NICIT accept liability for bank charges, e.g. for international bank transfers; these must be borne by the respective account holders - in the case of any doubt the buyer and the seller shall jointly be responsible for the costs incurred.
